The judicial doctrine of standing is important. It is a requirement that plaintiffs have a real stake in the outcome of a real controversy. This prevents, among other problems, persons bringing lawsuits simply to harass defendants. The judicial doctrine of standing is one of many judicial doctrines designed to limit the courts from being overloaded with cases that aren't properly resolvable by the courts, such as ripeness (case brought too soon), mootness (case brought too late), lack of jurisdiction, etc. When constitutional rights are at stake, courts have tended to give wider latitude to the standing of plaintiffs. The theory is that another person's loss of constitutional rights may indeed affect one's own constitutional rights. Judge Surrick's carefully worded opinion cites to cases where standing was at issue, including a similar case in which the eligibility of John McCain to be President was challenged. In deciding that "a candidate's ineligibility under the Natural Born Citizen Clause does not result in an injury in fact to voters," Judge Surrick writes in a footnote of potentially considerable consequence: If, through the political process, Congress determines that citizens, voters, or party members should police the Constitution's eligibility requirements for the Presidency, then it is free to pass laws conferring standing on individuals like Plaintiff. Until that time, voters do not have standing to bring the sort of challenge that Plaintiff attempts to bring . . . "Loving your country must mean accepting your responsibility to do your part to change it. If you do, your life will be richer, our country will be stronger."... Barack Obama's admission that his policies would "spread the wealth around" has ignited a nationwide discussion of how progressive the tax system should be and how it should be used to redistribute income among Americans. Obama has been very successful in bolstering the conventional wisdom that the U.S. tax system does not place a significant enough burden on wealthier households and places too much of a burden on the "middle class." But a new study on inequality by researchers at the Organization for Economic Cooperation and Development (OECD) in Paris reveals that when it comes to household taxes (income taxes and employee social security contributions) the U.S. "has the most progressive tax system and collects the largest share of taxes from the richest 10% of the population." As Column 1 in the table below shows, the U.S. tax system is far more progressive—meaning pro-poor—than similar systems in countries most Americans identify with high taxes, such as France and Sweden. Even after accounting for the fact that the top 10 percent of households in the U.S. have one of the highest shares of market income among OECD nations, our tax system is second only to Ireland in terms of its progressivity for households. Many who imagine themselves smart, educated and intellectual are reduced to schoolyard gibberish in denouncing John McCain and Sarah Palin - first and foremost Sarah Palin - and vowing obeisance to the Chicago messiah. The fanatics are particularly unhinged by inquiries into Mr. Obama's Chicago past, and what his associations on the South Side and in the intellectual warrens of Hyde Park say about who he really is, the beliefs he holds dearest (if any) and how his "palling around" with shady characters has eroded respect for his judgment. One typical correspondent, a distinguished professor at one of our most expensive universities, writes to scold me for mentioning Mr. Obama's association with William Ayers, the unrepentant '60s terrorist on whom the senator showered foundation money and now blandly describes as "just a guy from the neighborhood." There has been an explosion of polls this presidential election. Through yesterday, there have been 728 national polls with head-to-head matchups of the candidates, 215 in October alone. In 2004, there were just 239 matchup polls, with 67 of those in October. At this rate, there may be almost as many national polls in October of 2008 as there were during the entire year in 2004. Thus, the remainder, or $198.75 million, came from some 1.47 million people, each contributing $5, $10, $20... or, as Obama assured us, “whatever they could afford.” While it is true that Obama is the kind of guy who could read Bill Clinton’s golf scorecard and make it sound convincing, simple arithmetic should have told him that $198.75 million dollars cannot be contributed by 1.47 million people in “$5, $10, or $20” amounts. Each of those 1.47 million people would have had to contribute, on average, $135 to create a pool of $198.75 million... and that simply does not happen. It has never happened before in American politics and it is not happening now. In a Statement of Facts in the recent criminal trial of former UBS executive Bradley Birkenfeld, it was alleged that UBS took extraordinary steps to help American clients manage their Swiss accounts without alerting federal authorities. For example, UBS advised American clients to avoid detection by using Swiss credit cards to withdraw funds, to destroy all existing off-shore banking records, and to misrepresent the receipt of funds from their Swiss accounts as loans from the Swiss bank. According to The Nation, UBS established an elaborate training program which taught bank employees how to avoid surveillance by U.S. Customs and law enforcement, falsify visas, encrypt communications, and secretly move money in and out of the country... ” It is the perfect instrument for funneling illegal campaign contributions into the coffers of an unscrupulous American politician. Authorities at the University of Kentucky are trying to find out who hung an effigy of Democratic presidential candidate Barack Obama on campus. College spokesman Carl Nathe said it was found hanging from a tree Wednesday morning. Police immediately took it down. School President Lee Todd says that he plans to personally apologize to the Obama family on behalf of the university and that he is "personally offended and deeply embarrassed by this disgusting episode." As the case of Ashley Todd reminded us again last week, racial bias crimes are almost always hoaxes. Todd is the Republican volunteer who claimed that a black man in Pittsburgh had pummeled her and carved a "B" into her cheek after spotting the "McCain-Palin" bumper stickers on her car. A lot of people suspected the case was a hoax from the outset, including Fox News' Bill O'Reilly, who immediately said: "It could be bogus. I'm a little skeptical about this, but our duty ... is to report everything to you." (Editorial note: Fox News reported today that, at a rally earlier Tuesday, Joe "Joe the Plumber" Wurzelbacher agreed with a claim from an audience member that "a vote for Barack Obama is a vote for the death to Israel." Later, on Fox's "Studio B" segment, Shepard Smith pressed Wurzelbacher for specifics. The plumber cited Obama's willingness to talk unconditionally with countries like Iran, but was unable to further articulate the reason for his ambivalence. After the interview, Smith claimed that Obama has "repeatedly" claimed that "Israel will be a friend to the United States" and that (referring to the concerns of people like Wurzelbacher) "the rest of it...man...sometimes it just gets frightening".
